Terms of Service

These Terms of Service ("Terms") govern your use of services operated by Gumnut Labs LLC ("Gumnut," "we," or "us"): the Gumnut website, Gumnut Photos web and mobile apps, the Photos API, the Immich-compatible service, and Gumnut's MCP tools and other AI-assistant integrations (together, the "Services"). By creating an account or using the Services, you agree to these Terms. If you use the Services for an organization, you represent that you are authorized to agree on its behalf.

Eligibility and accounts

The Services are not intended for children under 13. If you are under 18, you may use them only with permission from a parent or legal guardian. You are responsible for providing accurate account information, protecting your account and API credentials, and promptly telling us through ourcontact page if you believe someone has used your account without permission. You are responsible for activity performed with credentials you issue or authorize, subject to applicable law.

Your photos and other content

You retain your rights in the photos, videos, metadata, and other content you upload or provide ("Your Content"). You must have the rights needed to provide Your Content and direct us to process or share it through the Services. If you add content to a shared library, people with access to that library may see and use it through the features and permissions you choose.

You give Gumnut a limited, non-exclusive license to host, store, copy, process, transform, and transmit Your Content only as needed to provide, secure, and support the Services and the features you choose. This includes creating previews, descriptions, embeddings, and other data derived from Your Content to make your library searchable and organized; working with service providers described in our Privacy Policy; and returning content to apps, API clients, and integrations you authorize. This license ends when the relevant content is deleted, subject to the deletion and backup periods in the Privacy Policy and any legal retention requirement. It does not transfer ownership of Your Content to Gumnut. We do not train our own AI models on your photos or videos.

You may download or export Your Content using available app, API, and SDK features. Deleting an individual photo or video normally moves it to a 90-day trash before permanent removal. You can also move an eligible library to trash and then request an expedited background purge through the API. Gumnut requires at least one active library, so contact us if you want all library data removed. The Privacy Policy explains these controls and backup periods in more detail.

AI assistants and third-party integrations

You may authorize third-party apps and AI assistants to access your Gumnut library. An authorized integration can receive the photos, thumbnails, metadata, and other results returned by its requests, according to the access granted to it. The third party's own terms and privacy policy govern its handling of data after it receives it. Review an integration's permissions before connecting it, and disconnect it when you no longer want it to have access. You are responsible for the prompts and instructions you send to third-party assistants.

AI-generated descriptions, search results, and assistant responses can be incomplete or inaccurate. Review them before relying on them for an important decision.

Acceptable use

You may use the Services only in compliance with applicable law and the rights of others. Do not upload or distribute content you have no right to use; access another person's account or library without authorization; probe, disrupt, or bypass the Services' security or rate limits; distribute malware; or send spam. Do not use API keys or integrations to exceed permissions granted to you. We may apply reasonable technical limits to protect the Services and other users.

Gumnut software and marks

Gumnut and its licensors retain their rights in the Services, software, designs, and trademarks. These Terms give you permission to use the Services as described here, but no ownership of them. Open-source components remain subject to their applicable licenses. You may not imply that Gumnut endorses your product or use our marks without permission.

Availability and payments

Gumnut Photos is free during early access, and Gumnut does not currently bill users for it. We may change or discontinue features, impose reasonable usage limits, or introduce paid plans in the future. We will give reasonable notice of material changes when feasible. We will present prices and payment terms and ask you to agree before charging you; these Terms do not authorize a charge. We do not promise uninterrupted availability or a particular service level unless we separately agree to one in writing.

Suspension, ending use, and deletion

You may stop using the Services at any time. You can delete individual items or eligible libraries using available controls and request help through ourcontact page. Deleting a Clerk identity does not itself delete photos or libraries stored by Gumnut; use the available deletion controls and contact us to remove any remaining library data. The Privacy Policy explains trash, backups, and retention.

We may suspend or restrict access when reasonably needed to address security, abuse, illegal activity, or a material breach of these Terms. We will provide notice and an opportunity to remedy a breach when reasonably practicable, but may act immediately when needed to protect the Services or others. If we end a Service, we will give reasonable notice and an opportunity to export content when feasible. Applicable law and the Privacy Policy govern retained data.

Changes to these Terms

We may update these Terms as the Services change. The date at the top of this page will show when a version takes effect. We will make reasonable efforts to notify users of material changes before they take effect. If you do not agree to updated Terms, you should stop using the Services and use the available export and deletion controls.
